Appeals Court Throws out VirnetX's Infringement Award vs. Apple

A federal appeals court threw out the jury order requiring Apple to pay VirnetX Holdings Corp $368.2M in damages earlier today, because although it was agreed that some patents were infringed, it was decided that the verdict was tainted by incorrect jury instructions on how to calculate damages, and by testimony from a VirnetX expert on how to determine potential royalties, which should have been excluded from the original proceedings.
