First, as to Plaintiff's motion to strike language limiting the number of outside counsel and Outside Consultants with access to source code, IT IS ORDERED that the motion is GRANTED in part. Specifically, the disputed language of § 5 of the Protective Order, see D.I. 24-1, Ex. A at 1, shall read "(ii) absent good cause, it shall be disclosed to no more than five (5) Outside Consultants per party designated under Section 3(d) above, and (iii)" and § 8(j) of the Protective Order, id. at 4, shall read "Absent good cause, access to the stand-alone computer shall be limited to five (5) outside counsel representing the Requesting Party and five (5) Outside Consultants who have been approved to access 'RESTRICTED CONFIDENTIAL - SOURCE CODE' materials." Second, with respect to the proposed source code review log, D.I. 24 at 2-3, IT IS ORDERED that Plaintiff's motion is DENIED. The proposed language in § 8.2(b) of the Protective Order, see D.I. 24-1, Ex. A at 6, only requires a log of "any individual who has inspected any portion of the Source Code in electronic or paper form." Id. "The record shall include the names of the recipients and reviewers and copies and locations where the copies are stored." Id. It does not require, as Plaintiff maintains, a log of the attorneys who have reviewed the source code, the portions of the source code each attorney has reviewed, and when the access occurred. Thus, Plaintiff has not articulated a basis on which the requested review log would violate privilege. Third, as to the number of printed pages of source code, D.I. 24 at 3, counsel for Plaintiff stated during the teleconference that the parties had reached agreement and that this issue was no longer in dispute. Fourth, with regard to Defendant's proposed limitations to the scope of e-mail discovery in the proposed ESI Order, D.I. 24 at 3-4; D.I. 24-1, Ex. B, IT IS FURTHER ORDERED that Plaintiff's motion is GRANTED. Defendant offers no basis to limit the scope of e-mail discovery to specific "topics" beyond the five (5) custodians and five (5) search terms to which the parties have already agreed. Defendant has argued that document production will provide Plaintiffs with the discovery sought and that e-mail is of "limited value" in documenting these topics. In view of what Defendant maintains will be an especially burdensome collection and production process fraught with "duplicative" search results, Defendant essentially proposes to "pre-screen" the ESI searches by removing all e-mail related to specific topics before carrying out the searches. In the court's experience, ESI platforms routinely address duplication and have the technical ability to find, identify, and to withhold production of duplicated e-mails and attachments. In view of the fact that discovery has not yet begun, Defendant's claims of burden are premature and speculative. Finally, Defendant cites to the Epic Games case from the Northern District of California as a basis for the reduced scope of discovery Defendant requests here. D.I. 25 at 4 (citing D.I. 25-1, Ex. 2). Although Plaintiff stipulated to limited ESI searching in the protective order in that matter, the court notes that that the Northern District of California's local rules for patent cases differ from this court's.
