If what is discussed in the September 19 letter moots any of the relief ordered below, the parties can tell the Court that during the teleconference today. The Court thus ORDERS as follows: (1) With regard to the dispute as to Interrogatory No. 1 ("ROG 1"), Defendant raised two issues. The first issue was Defendant's objection to Plaintiff's use of "at least as early as" when setting out dates for conception and reduction to practice. (D.I. 176 at 1-2) This issue seems to have been obviated by Plaintiff's later assertion of firm dates (albeit not via supplementation of its answer to ROG 1, but instead in its Final Infringement Contentions) that do not contain that "at least as early as" caveat. (D.I. 203, ex. 1 at 29) That said, Plaintiff still needs to supplement its answer to ROG 1 to include these new, firm dates; in doing so, it should also provide a further written narrative that makes clear the "facts and circumstances [r]elating [t]o the [new] conception and reduction to practice" dates. (D.I. 176, ex. 1 at 6) It shall do so by no later than 7 days from today's date. The second issue raised by Defendant relates to the fact that in its response to ROG 1, Plaintiff had asserted that Dr. Dauger drafted a particular document in September 2005, but Plaintiff did not therein tell Defendant all of the evidentiary bases that support Plaintiff's claim that this document was in fact drafted in that month. (D.I. 176 at 2) In the Court's view, ROG 1 itself does not clearly call for a description of all of the pieces of evidence that Plaintiff will use to support the various statements made in its ROG response, such as the statement that Dr. Dauger drafted this document in September 2005 (i.e., the ROG does not require Plaintiff to explain that it was able to identify the month as September 2005 because Dr. Dauger remembered that date during an interview, or because Dr. Dauger or someone else memorialized that date in certain notes, etc.). Such information is the kind of thing that would typically be explored in a later deposition. And lastly, to the extent Defendant suggests in its reply brief that these new conception and reduction to practice dates should be stricken as untimely, (D.I. 203 at 1), such a request is not fairly part of the issues that were raised in the briefing here.
