Plaintiffs report that the Patent Trial and Appeal Board ("PTAB") has instituted inter partes review ("IPR") of the asserted patent, U.S. Patent No. 9,179,711 (the '711 Patent), and request that the court extend the current stay while IPR proceedings are pending. Defendant Nested Bean, Inc., opposes a stay. Defendant contends that as a result of the court's Claim Construction Order [61], the case "is effectively over," and the court should dismiss the action and close the case. However, Defendant agrees that, in the case the court is not prepared to dismiss the case, the matter should be stayed pending the resolution of IPR. For the reasons set forth below, Plaintiffs' Motion to Stay [73] is GRANTED.The case is not "effectively over." In the Joint Status Report [69], Plaintiffs stated that they sought to substitute for their Unjust Enrichment count a claim for inducement to infringe and asked the court to lift the current stay to allow them to file a motion to amend. Id. at 1-2. They offered in the alternative to stipulate to a partial judgment dismissing the claim of direct infringement such that they could appeal the claim construction decision. Id. at 2-3. Defendant suggested that the court should dismiss the Complaint, which would allow Plaintiffs' appeal of the claim construction order, or in the alternative, to set a briefing schedule for summary judgment, and that "[a]fter the appeal, [Plaintiffs] can decide whether to file a new lawsuit on any unpled claims." Id. at 3-5. Under either proposal, the parties' dispute would continue to be litigated. Defendant argues now that the stay should be denied because the case is "close to resolution." But the court previously stayed the action to focus these proceedings on the claim construction question as presented by Defendant's Motion to Dismiss [21], and expressly noted at the time that the stay would not prejudice either party regarding potential amendments to the pleadings should the stay be lifted. Consent Order 2 [49]. Accordingly, if the stay is lifted, Plaintiffs would not be barred from filing their motion for leave to amend. As to the argument that there is no need to wait for the IPR decision because Plaintiffs have conceded that there is no infringement at all, Defendant misconstrues Plaintiffs' position. As depicted in the various images of the accused infringing device filed in this action, Plaintiffs' indirect infringement argument is based on a claim that Defendant explicitly induces its customers to infringe. See e.g., Pls.' Reply 2-3 [77].Accordingly, as the court is not prepared to dismiss the action at this time, and as Defendant agrees that if the court does not dismiss the action, the matter should be stayed, Plaintiffs' motion is GRANTED. The action is STAYED pending resolution of IPR proceedings, including any appeals to the Federal Circuit from the PTAB's ruling.
