Plaintiff explains that under the Court's default protective order for patent cases, defendant "must move the Court promptly for a ruling" on its objections to plaintiff's disclosed experts. 70 1. Plaintiff adds that until defendant files a motion, plaintiff is unable to use the challenged experts to review defendant's technical documents to help it prepare its final infringement contentions that are due 10/24/2023. [Id.]. Under Local Patent Rule (LPR) 1.4, the protective order found in LPR Appendix B "shall be deemed to be in effect as of the date of each party's initial disclosures." Here, the parties already exchanged initial disclosures for the default protective order to apply. [66-1] 1. Plaintiff is correct that under the default protective order, if a party objects to the disclosure of confidential information to a consultant or expert, and the parties do not resolve the dispute within ten days after service of the objection, "the producer must move the Court promptly for a ruling, and the Confidential or Highly Confidential information may not be disclosed to the expert or consultant without the Court's approval." LPR App. B, 4(e). According to plaintiff's motion, defendant served its objections on 08/04/2023, and the parties have been unable to resolve the dispute since 08/17/2023. 70 1-2. In light of the parties' inability to resolve the dispute within ten days of defendant serving its objections, defendant must file any motion for a ruling on its objections without delay. "Promptness is generally defined as without unreasonable delay, performed readily, or immediately or given without delay." United States v. Smith, 21 CR 703-2, 2022 WL 4608259, at *2 (N.D. Ill. Sept. 30, 2022) (internal citations omitted). For these reasons, plaintiff's motion 70 is granted in part. Defendant must file any motion for a ruling on its objections by 09/01/2023. A joint status report is due on 9/29/2023 to update the Court on: (a) the progress of discovery; (b) the status of settlement discussions, if any; and (c) any other issues the parties wish to raise with the Court.
