Apr 8, 2021 29 MINUTES (IN CHAMBERS) Order GRANTING-IN-PART and DENYING-IN-PART Plaintiff's Motion for Default Judgment by Judge Andre Birotte Jr.: Plaintiff's Motion for Default Judgment 25 is GRANTED-IN-PART and DENIED-IN-PART. The Court GRANTS the Motion as to liability on Plaintiff's patent infringement claim. The Court GRANTS leave for Plaintiff to engage in limited discovery to determine the existence and amount of damages. Plaintiff's request for damages is DENIED WITHOUT PREJUDICE to renewal upon demonstrating entitlement to such damages and corresponding attorney's fees under Local Rule 55-3. Plaintiff's request for treble damages under 35 U.S.C. Section 284 is DENIED. Finally, Plaintiff's requests for a finding that this case is exceptional and for attorney's fees under 35 U.S.C. Section 285 are DENIED. If Plaintiff intends to pursue the allowed limited discovery and renew its requests following this Order, Plaintiff must complete the discovery and file a renewed motion for relief within 90 days of entry of this Order.
