Oct 25, 2020 | 169 | text entry (2) Docket Text: MINUTE entry before the Honorable John F. Kness: Motion hearing held on 10/23/20. As discussed on the record, Plaintiff's response to the Sherinian Defendants' motion for reconsideration [168] is due on or before 11/6/20. Sherinian Defendants' reply (if any) is due on or before 11/13/20. In the Court's 10/14/20 order [166] granting and denying in part Plaintiff's motion [65] for an extension of the preliminary injunction, the Court directed Plaintiff to submit a proposed, revised preliminary injunction order consistent with the relief described in the order on or before October 19, 2020. Plaintiff failed to meet this requirement. Accordingly, consistent with the discussion on the record during the 10/23/20 hearing, Plaintiff's counsel is specifically ordered to provide a proposed, revised preliminary injunction order consistent with the relief described in the 10/14/20 order on or before 5 p.m. CDT on 10/26/20. The proposed order must be submitted by email, in MS Word format, to proposed_order_kness@ilnd.uscourts.gov with all counsel copied. Separately, the Court discussed whether a continued evidentiary hearing will be warranted on Plaintiff's motion [65] to extend the preliminary injunction as to the Dykema Defendants. As to that issue, Plaintiff is directed to file, on or before 10/30/20, a written statement addressing whether Plaintiff's motion to extend [65] requires a continued evidentiary hearing. As discussed on the record, Plaintiff may also address whether Plaintiff bears the burden of proof and persuasion on her motion to extend the preliminary injunction. Plaintiff's statement may not exceed 15 pages. Dykema Defendants' reply (if any) is due on or before 11/6/20 and may be of equal length. A continued telephonic motion hearing is set for 11/12/20 at 11:45. At that hearing, the parties must also be prepared to discuss a case management schedule to govern the remainder of this litigation. For the reasons provided previously by the Court, the existing preliminary injunction will remain in effect as to the Dykema Defendants until 11/12/20 or further order of the Court. Mailed notice. Jul 19, 2020 | 109 | order on motion for protective order (2) Docket Text: MINUTE entry before the Honorable John F. Kness:The renewed motion of certain Defendants for entry of a confidentiality order [108] is granted. A confidentiality order will be entered separately on the docket. Although it appears, based on comments statements made at the July 14, 2020 hearing, that Plaintiff does not generally oppose the entry of a confidentiality order, an email colloquy that Defendants appended to their present motion suggests that Plaintiff opposes at least one aspect of the "Highly Confidential Information" designation proposed by Defendants. Although the Court is very sympathetic to Plaintiff's overall view of the need for litigation to be generally transparent to the public, the issue here concerns the production of information in discovery, not the propriety of filing anything under seal on the public docket. Information asserted to be confidential is regularly produced under the strictures of a confidentiality order. See, e.g., Nuratech, Inc. v. Syntech Int'l, Inc., 242 F.R.D. 552, 556 (C.D. Cal. 2007). If and when any party seeks to file information under seal, the Court will address the request without deference to any confidentiality designation supplied by a party. In addition, the confidentiality order being entered separately further provides a mechanism for challenging confidentiality designations. For these reasons, as well as the reasons provided in Defendants' motion [108], the motion for a proposed confidentiality order is granted. Mailed notice (jk) |

Jul 14, 2020 | 106 | order on motion for protective order (2) Docket Text: MINUTE entry before the Honorable John F. Kness: Continued telephonic hearing held on July 14, 2020 concerning Plaintiff's motion [65] to extend the existing preliminary injunction. Having reviewed the supplemental briefing of the parties and considered the arguments of counsel at the June 26, 2020 hearing [87], the Court finds that an evidentiary hearing is necessary to determine whether continued preliminary injunctive relief is appropriate. Among other things, and as explained at the July 14 hearing, the Court will consider evidence and argument relating to (a) the relationship, if any, between the defendants who have appeared in this action, other defendants, and the entity known as "Banggood"; (b) the alleged infringement of Plaintiff's trademarks and copyrighted materials; (c) whether the defendants who have appeared can reasonably be found to be jointly and severally liable for the alleged infringing conduct of other entities; and (d) whether a continued asset restraint is warranted and, if so, to what extent. With respect to "Banggood," Plaintiff stated that she may seek to add "Banggood" as a defendant, but the entity is not presently a defendant in this action. Accordingly, Banggood itself will not be a subject of the July 28 hearing even if it is added as a defendant before the hearing. The evidentiary hearing will be limited to one day and is set for July 28, 2020 at 10:00 AM. Preliminary witness and exhibit lists must be filed on or before July 21, 2020. Any renewed motion for a protective (confidentiality) order must be filed on or before July 17, 2020, and any proposed confidentiality order (in MS Word format) must be submitted on or before that same date to proposed_order_kness@ilnd.uscourts.gov. Any party that seeks a confidentiality order must base its proposed order on the Court's Form LR 26.2 model confidentiality order, which is available on the website of the Northern District of Illinois. Proposed changes must be reflected in redlined or comparison form as an attachment to the motion for a confidentiality order. Defendant's motion [89] for a protective order is denied as moot in view of the relief provided in this order. Plaintiff's motion [101] to strike all or parts of various documents filed by Defendants is denied without prejudice to renewal at the evidentiary hearing. For the reasons stated at the July 14 hearing and in support of the previous temporary restraining order [34][35] and the preliminary injunction [50][51][54][55], the preliminary injunction [55] will remain in effect through July 28, 2020. As discussed in open court, on or before July 10, 2020, the following parties shall file supplemental briefs of up to 20 pages (not including exhibits): Plaintiff, Defendants represented by counsel Michael Adams, and Defendants represented by counsel Konrad Sherinian. The supplemental briefs must address the following topics, but only with respect to the parties identified in this order: first, Plaintiff's likelihood of success on her trademark-related claims; second, Plaintiff's likelihood of success on her copyright-related claims; third, whether the current asset restraint amount of $45,000 per account is justified; and fourth, whether there is sufficient evidence to justify a preliminary asset restraint in any amount. As further discussed in open court, Defendants represented by counsel Konrad Sherinian shall, by 5 p.m. CDT on July 3, 2020, provide responses to Plaintiff's discovery requests relating to Defendants' identity and the storefronts through which they and alleged affiliates engage in commerce. Jun 23, 2020 | 86 | order on motion for leave to file (1) Docket Text: MINUTE entry before the Honorable John F. Kness: Docket entries 83, 84, and 85 are stricken. In an order [79] entered on June 15, 2020, the Court stated, "No party may make any further entries on the docket without the express leave of Court, and motions for leave to file additional briefing papers or other materials are discouraged." Based on Defendants' representation to a member of the Court's staff that their June 16, 2020 motion for an extension of time to answer [80] was unopposed, and given the impending deadline, the Court allowed that motion to be filed. No similar steps have been taken with respect to docket entries 83, 84, and 85. Accordingly, the entries are stricken without prejudice to later refiling. As the record reflects, there is a hearing in this case set for June 26, 2020; the Court will give the parties an opportunity to address various issues at that hearing, and the Court will discuss how this litigation will be managed for the remainder of the case. Following the hearing, the Court will lift the temporary restriction on the parties' ability to make docket entries. To reiterate: until further order, no party may make any further entries on the docket without the express leave of Court. Mailed notice (ef, ) |
