As discussed on the record, Plaintiff's response to the Sherinian Defendants' motion for reconsideration [168] is due on or before 11/6/20. Sherinian Defendants' reply (if any) is due on or before 11/13/20. In the Court's 10/14/20 order [166] granting and denying in part Plaintiff's motion [65] for an extension of the preliminary injunction, the Court directed Plaintiff to submit a proposed, revised preliminary injunction order consistent with the relief described in the order on or before October 19, 2020. Plaintiff failed to meet this requirement. Accordingly, consistent with the discussion on the record during the 10/23/20 hearing, Plaintiff's counsel is specifically ordered to provide a proposed, revised preliminary injunction order consistent with the relief described in the 10/14/20 order on or before 5 p.m. CDT on 10/26/20. The proposed order must be submitted by email, in MS Word format, to proposed_order_kness@ilnd.uscourts.gov with all counsel copied. Separately, the Court discussed whether a continued evidentiary hearing will be warranted on Plaintiff's motion [65] to extend the preliminary injunction as to the Dykema Defendants. As to that issue, Plaintiff is directed to file, on or before 10/30/20, a written statement addressing whether Plaintiff's motion to extend [65] requires a continued evidentiary hearing. As discussed on the record, Plaintiff may also address whether Plaintiff bears the burden of proof and persuasion on her motion to extend the preliminary injunction. Plaintiff's statement may not exceed 15 pages. Dykema Defendants' reply (if any) is due on or before 11/6/20 and may be of equal length. A continued telephonic motion hearing is set for 11/12/20 at 11:45. At that hearing, the parties must also be prepared to discuss a case management schedule to govern the remainder of this litigation. A confidentiality order will be entered separately on the docket. Although it appears, based on comments statements made at the July 14, 2020 hearing, that Plaintiff does not generally oppose the entry of a confidentiality order, an email colloquy that Defendants appended to their present motion suggests that Plaintiff opposes at least one aspect of the "Highly Confidential Information" designation proposed by Defendants. Although the Court is very sympathetic to Plaintiff's overall view of the need for litigation to be generally transparent to the public, the issue here concerns the production of information in discovery, not the propriety of filing anything under seal on the public docket. Information asserted to be confidential is regularly produced under the strictures of a confidentiality order. See, e.g., Nuratech, Inc. v. Syntech Int'l, Inc., 242 F.R.D. 552, 556 (C.D. Cal. 2007). If and when any party seeks to file information under seal, the Court will address the request without deference to any confidentiality designation supplied by a party. In addition, the confidentiality order being entered separately further provides a mechanism for challenging confidentiality designations. Among other things, and as explained at the July 14 hearing, the Court will consider evidence and argument relating to (a) the relationship, if any, between the defendants who have appeared in this action, other defendants, and the entity known as "Banggood"; (b) the alleged infringement of Plaintiff's trademarks and copyrighted materials; (c) whether the defendants who have appeared can reasonably be found to be jointly and severally liable for the alleged infringing conduct of other entities; and (d) whether a continued asset restraint is warranted and, if so, to what extent. With respect to "Banggood," Plaintiff stated that she may seek to add "Banggood" as a defendant, but the entity is not presently a defendant in this action. Accordingly, Banggood itself will not be a subject of the July 28 hearing even if it is added as a defendant before the hearing. The evidentiary hearing will be limited to one day and is set for July 28, 2020 at 10:00 AM. Preliminary witness and exhibit lists must be filed on or before July 21, 2020. Any renewed motion for a protective (confidentiality) order must be filed on or before July 17, 2020, and any proposed confidentiality order (in MS Word format) must be submitted on or before that same date to proposed_order_kness@ilnd.uscourts.gov. Any party that seeks a confidentiality order must base its proposed order on the Court's Form LR 26.2 model confidentiality order, which is available on the website of the Northern District of Illinois.
