(D.I. 21) With regard to the dispute about case narrowing, it does not make sense to the Court to put off the decision as to what particular case narrowing targets should be at play in the case until August 17, 2022 (a date just two weeks before the date on which the first cut down will occur). Among other reasons, if the parties could not agree on these targets, then the Court would be required to resolve the dispute thereafter, and that would leave little time for the parties to plan accordingly before the first cut down date (on September 2, 2022) would take effect. Instead, it makes sense to the Court to take up the case narrowing issue sooner rather than later, and to resolve any disputes regarding case narrowing in the near term. To that end, the Court hereby ORDERS that by no later than April 18, 2022, the parties should meet and confer and file a joint letter of no more than four (4) single-spaced pages that provides the parties' respective positions (and any supporting arguments) as to how many patent claims should be asserted and how many prior art references/prior art arguments should be elected as of both the first and second proposed cut down dates. To guide the parties, the Court hereby refers to them its decisions in the following cases regarding case narrowing: Civil Action Nos. 20-1197, 19-145, 18-300, 17-1390, 17-871, 17-600, 16-380, 15-980, 15-819, and 14-721.
