This motion, which was filed two days before the close of fact discovery on 12/12/20 (see Dkt. 56), is more accurately described as a motion for a five-month extension of the discovery deadline. In support of their motion, the parties refer variously to the addition of a new defendant, which is apparently a corporate affiliate or parent of the original defendant, as well as the conclusory and unsupported statement that the parties have "diligently pursued discovery." Also cited is the "current pandemic," which notably was also a factor at the time the governing scheduling order was adopted, with full input from the parties, in July 2020. No details are provided, however, as to why oral discovery has apparently not even begun, nor is there any explanation as to why the addition of a corporate-affiliate defendant should serve as the basis for a five-month extension of discovery in this over one-year-old case. Rule 16(b)(4) of the Federal Rules of Civil Procedure requires a showing of "good cause" before a governing schedule can be modified. Based at least on the content of the parties' joint motion, that standard has not been met. Accordingly, the joint motion is denied, and fact discovery is now closed. If the parties wish to seek leave to conduct additional fact discovery, they will need to file a motion to reopen discovery and will need to support any such request with detailed facts showing good cause to modify the schedule governing this case. This action concerns alleged trademark infringement under the Federal Trademark Act, but the parties have proposed the form protective order in Appendix B to the Local Patent Rules without explaining why the provisions of that form order are superior to Form LR26.2. Even if the "Appendix B" form protective order was more appropriate here, Rule 1.4 of the Local Patent Rules states that "any party may move the Court to modify the Appendix B protective order for good cause."
