The motion argues the parties' 2/28/2025 joint status report 43 should be sealed because it "contains information that the parties have classified as Highly Confidential under the Agreed Confidentiality Order." The Court disagrees that the status report contains information covered by the confidentiality order. Further, the parties have not articulated how the status report contains information that falls within a category recognized by this Circuit as deserving secrecy: trade secrets, information covered by a recognized privilege, and information required by statute to be maintained in confidence. Baxter Inter., Inc. v. Abbott Laboratories, 297 F.3d 544, 546-47 (7th Cir. 2002). Accordingly, the Court is not inclined to grant the motion and clarifies that the previous motion to seal 40 was granted in error. By 3/7/2025, the parties may: (1) move to withdraw 39 and 43 ; (2) inform this Court that 39 and 43 may be unsealed; or (3) file a supplemental motion to seal 39 and 43 articulating with specificity "the propriety of secrecy, providing reasons and legal citations." Id. at 548. The clerk of the Court is directed to maintain 39 and 43 under seal until further order of the Court.
