As of today, Fintech has not appeared by new counsel. As an LLC, Fintech "cannot litigate pro se or be represented in the litigation by a nonlawyer." 1756 W. Lake St. LLC v. Am. Chartered Bank, 787 F.3d 383, 385 (7th Cir. 2015). Fintech apparently told Wawrzyn on 10/7/2022 that it would be seeking new counsel; Wawrzyn then attempted to follow up with Fintech about whether it had obtained new counsel, but Fintech did not respond, other than to inform Wawrzyn that his "services [were] terminated" on 12/22/2022. (Dkt. 14 .) Having given Fintech "express warning," see Ball v. City of Chicago, 2 F.3d 752, 756 (7th Cir. 1993), that it faced dismissal if it did not appear by new counsel, the court now concludes that dismissal for want of prosecution is appropriate. See Matter of Bluestein & Co., 68 F.3d 1022, 1025 (7th Cir. 1995) ("District courts possess the inherent authority to dismiss a case sua sponte for want of prosecution as part of the 'control necessarily vested in courts to manage their own affairs so as to achieve the orderly and expeditious disposition of cases.'") (citation omitted). The case is dismissed with prejudice pursuant to Fed. R. Civ. P. 41(b). The pending motion to dismiss for failure to state a claim (dkt. 7 ) is terminated as moot.
