| May 28, 2021 | N/A | Order Reopening Case (0) Docket Text: PAPERLESS ORDER REOPENING CASE: This matter is before the Court upon the Plaintiffs' supplemental status report regarding service of process and motion to reopen. [21]. In their report, the Plaintiffs state they received correspondence from counsel for the Defendants on April 28, 2021, indicating the Defendants had been served and that they were seeking a 21-day extension of time, through May 19, 2021 to respond to the Plaintiffs' complaint. The Plaintiffs did not inform the Court the Defendants had been served and neither party thought to inform the Court that an extension of time was being sought. The Plaintiffs state they did not file evidence of service on the docket because the Central Authority in Mexico has been delayed in providing documents evidencing service due to COVID-19 restrictions and closures. While this may be true, the Plaintiffs failed to explain why they failed to file other proof of service, such as the correspondence from Defendants' counsel that they attached to the status report. The Plaintiffs further advise that on May 19, 2021, Defendants' counsel requested an additional 30-day extension of time for the Defendants to respond to the Plaintiffs' complaint. The Plaintiffs state they acceded to the Defendants' request on the condition that the Defendants file a motion with the Court seeking the requested extension. The Plaintiffs report that the Defendants did not file such a motion because they believed the Court must reopen the case in order for them to seek such relief. The Court notes at the outset that parties may not agree to modify deadlines set by the Court or the Federal Rules simply by agreement amongst themselves--they must seek leave of the Court to do so. Any other conclusion would deprive the Court of its ability to efficiently manage its docket. See, e.g., Dietz v. Bouldin, 136 S. Ct. 1885, 1888-89 (2016). The Court, therefore, admonishes the parties for making agreements amongst themselves as to deadlines without timely informing the Court and seeking appropriate relief. The parties are warned that similar conduct at future stages in this litigation will result in the Court entering appropriate sanctions against one or both of the parties, as necessary. To avoid unnecessary motion practice and further complication, the Court also construes the instant status report and motion to reopen as an unopposed motion for extension of time. The Court grants the extension and orders the Defendants to respond to the Plaintiffs' complaint no later than June 18, 2021. The Court directs the Clerk to reopen this matter.
