Defendant Medicreations, LLC moves to redact and seal certain portions of its response to Plaintiff Hydrafacial LLC's opening claim construction brief. Defendant argues that the Court should seal these materials because they are excerpts from depositions of the asserted patents' inventors during an International Trade Commission investigation, which transcripts are marked confidential under an International Trade Commission protective order. However, the fact that a document is designated confidential under a protective order does not, standing alone, establish sufficient grounds to seal that filed document. See Foltz v. State Farm Mut. Auto. Ins. Co., 331 F.3d 1122, 1133 (9th Cir. 2003); see also Beckman Indus., Inc. v. Intl Ins. Co., 966 F.2d 470, 476 (9th Cir. 1992). So, Defendant must provide some additional reasoning in order for the Court to "articulate the factual basis for its ruling without relying on hypothesis or conjecture." See Kamakana v. City and County of Honolulu, 447 F.3d 1172, 1179 (9th Cir. 2006). The Court will therefore DENY the motion to seal without prejudice. (ECF No. 108 ). The Court will keep the material at issue under seal until December 29, 2025, so that Defendant may file a renewed motion to seal. If Defendant does not file a renewed motion to seal before this date, the Court will order the materials unsealed. IT IS SO ORDERED.
