Nov 9, 2023 184 MINUTE entry before the Honorable Jeffrey Cole: Video conference held off the record. Settlement related discussions held. Over the past two months counsel for the parties and I have engaged in a series of conferences to determine whether a formal settlement conference would be in the interest of the parties and in the broader "interest of justice." [147, 151, 155, 157, 171]. Today marked the sixth such conference in this case. Unfortunately, counsel and their clients continue to have quite different assessments of the case and its probable outcome if a settlement were not to be reached. And while counsel have made headway in one area, they and their clients continue to be far apart in others. As things now stand, it is not in the interest of either of the parties, or of the court as an institution, to have a formalized settlement conference. After all, not every case can be settled, and not all settlement conferences are ultimately in the public's interest. I have asked, however, for counsel and their clients to confer and to convey privately to me their minimum demand and maximum offer of settlement. Those numbers and conditions will not be communicated to the other side by counsel or the court, and will be utilized solely by the court in assessing whether there is any reasonable prospect of this case being settled or whether it must be tried. Counsel are to submit their respective positions privately to me through my courtroom deputy, Yulonda Thomas, no later than 11/17/23 by noon. In making the determination of whether it is in the client's best interest that this case be settled, the clients and counsel should not forget there is no such thing as a sure winner as anyone who tries cases knows. Kern v. Levolor Lorentzen, Inc., 899 F.2d 772, 781 (9 th Cir. 1990)(Kozinski, J., dissenting). And that includes patent cases no less than other kinds of cases. See e.g., Minemyer v. R-Boc Representatives, Inc., 839 F. Supp. 2d 1004, 1018 (N.D. Ill. 2012). As the late Judge Will sagely noted, the "best" case can be lost and the "worst" case can be won and juries may find liability but no damages. [Here, both parties have asked for trial by jury][1, 51]. None of these risks should be underestimated." Matter of Superior Beverage/Glass Container Consol. Pretrial, 133 F.R.D. 119, 127 (N.D. Ill. 1990). See also In re Wash. Pub. Power Supply Sec. Litig., 19 F.3d 1291, 1300 (9th Cir. 1994) (examining the role of risk in litigation); In re Dynamic Random Access Memory (DRAM) Antitrust Litig., 2013 WL 12387371, at *20 (N.D. Cal. 2013). "Juries can be unpredictable so there is always a possibility of liability in a jury trial even in the strongest of cases." Surgery Center at 900 N. Michigan Ave, LLC v. American Physicians Assurance Corp., Inc., 922 F.3d 778, 785 (7th Cir. 2019). See also Nat'l Indem. Co. v. Chipman, 2013 WL 12303139, at *14 (D. Utah 2013)("[e]stimating likely jury verdicts is by its very nature an unpredictable pursuit, and from time to time juries are bound to return verdicts that are either substantially more or substantially less than the insurer's [or counsel's] estimates."). As a consequence of the discussions today, counsel for the parties have agreed with the Court's suggestion that there be further discussions regarding design changes, and that additional information discussed today will be provided and discussed among the parties. It was also agreed that there will be a further discussion regarding what would constitute a satisfactory financial component of any settlement of this case. A further preliminary settlement discussion regarding settlement is continued to 10/18/23 at 9:30am. In the interim, counsel for the parties are urged to speak with each other regarding the above agreed to exchanges of information discussed in today's hearing. However this morning, my courtroom deputy received an email from counsel for one of the parties informing me that the opposite party had refused to even discuss a possible monetary settlement amount and questioning, understandably, whether a preliminary settlement discussion with the Court ought to proceed. To quote the Seventh Circuit in Goss Graphics Sys., Inc. v. Dev Indus., Inc., 267 F.3d 624, 627 (7th Cir. 2001), "If parties want to duke it out, that's their privilege." But, long experience teaches that that sort of inflexibility is not always the best course to pursue. While that concern is certainly understandable, I think it nonetheless worthwhile to proceed with the preliminary settlement discussion scheduled for 10/2/23.
