While each party hotly contests whether the law permits a stay or not, the issue is really one of the Court's discretion under FRCP 16 to manage the litigation schedule to best achieve the purposes of Rule 1. Certainly, the Hatch-Waxman 30-month regulatory stay causes a wrinkle, but that can easily be solved: Bench trial set for October 5, 2026. This is well before the expiration of the stay, which Plaintiffs represents expires on February 26, 2027, and is sufficient time for the parties to try the case and for the Court to issue a ruling. Joint status report with a proposed schedule for submission of the pretrial order and motions in limine is due by 12/13/24, along with a statement on the expected length of trial. With that, the Court sees no more prejudice to allowing a partial stay for a motion to dismiss that could potentially streamline the litigation and/or dismiss certain parties, and which motion will be fully briefed in December. On that note, Plaintiffs' response brief will be due 12/9/24 and the reply brief will be due by 12/17/24, given that the parties will likely duplicate what they already did before consolidation. With the motion fully briefed in December, the Court will issue a written decision a few months after that. As for discovery, the Court will permit certain written discovery to proceed at this time: Rule 26(a)(1) disclosures are due by 1/10/25 and written interrogatories may be issued by 2/7/25. No other discovery is permitted at this time to ensure that costly discovery is not undertaken unnecessarily.
