Docket Text: MINUTE entry before the Honorable John J. Tharp, Jr:This case is dismissed without prejudice as improperly filed. No defendants were named in the complaint [1] at the time it was filed; Schedule A [7], purportedly attached to the complaint, did not in fact accompany the complaint and was not filed until after the case had been assigned to this Court's docket. The complaint was therefore invalid at filing, and the practice of deferring disclosure of the identification and number of defendants until after the case has been assigned gives rise to concerns regarding forum shopping and undermines the integrity of the Court's random case assignment process. If Plaintiff wishes to further pursue the claims asserted in the complaint filed in this matter, a complaint that includes the identified defendants must be filed to initiate a new case, which will then be assigned randomly pursuant to the Court's standard procedures. Any new filing of the claims set forth in the complaint filed in this case should not be designated as a refiling of this case or as a related case to this case. To the extent that the plaintiff seeks to file the names of the defendants under seal, the plaintiff should file the case under seal per Local Rule 5.7. This case is terminated; all pending motions are denied without prejudice as moot.
