Mar 2, 2017 2 ORDER (SHWARTZ, GREENBERG and FISHER, Circuit Judges) The Clerk is directed to transfer this appeal and appellant's filings to the United States Court of Appeals for the Federal Circuit. The Federal Circuit will have exclusive appellate jurisdiction over the final decision in this matter because appellant's amended complaint includes claims for patent infringement. The Federal Circuit will have such jurisdiction even though appellant's amended complaint contains other kinds of claims because "[t]he existence of a single claim created by federal patent law is sufficient to trigger the Federal Circuit's exclusive appellate jurisdiction over the entire case; the fact that a complaint also asserts non-patent claims... is immaterial." 17 Charles Alan Wright et al., Federal practice and Procedure (3d ed. 2016) (collecting cases). We note that it appears that the Federal Circuit may not have jurisdiction over this appeal because the order appealed from dismissed only appellant's claims against Judge Andrews and appellant's other claims remain pending in the District Court. Thus, though we express no opinion on the issue, it would appear taht the order may not be a "final decision" for purposes of Section 1295(a)(1). Nevertheless, we believe it more appropriate for the Federal Circuit to determine its own jurisdiction over this appeal, filed. Panel No.: CLD-141. Greenberg, Authoring Judge.
