The Court sets the Claim Construction hearing for a one-day hearing on 10/05/2023 to begin at 9:00 a.m. in Courtroom 1941. The Court will allow expert testimony. Each side will have a total of 210 minutes (to use as they see fit) to present arguments, including time for rebuttal, and to conduct any examination (direct and cross) of any experts. To be clear, the 210 minutes is inclusive of all time each party will have to present their case and to cross-examine witnesses. Each party shall be prepared to keep time for the hearing. The hearing will start with opening arguments and then proceed term-by-term, with each side presenting all arguments for a term before moving to the next term. For the reasons discussed on the record, based on the Court's application of the four-part test set forth inJohnson & Johnson v. Advanced Inventory Management, Inc., 20 CV 3471, 2020 WL 5097076, at *1 (N.D.Ill. Aug. 28, 2020), defendant's oral motion for a stay of discovery pending the District Court Judge's ruling on defendant's objections 276 to this Court's 1/5/23 Memorandum Opinion and Order 275 is denied. Even presuming that defendant has a likelihood of success on the merits of its objections (which plaintiff vehemently disputes), defendant has failed to show that it will suffer irreparable injury absent a stay of discovery. The Court further finds that plaintiff has an interest in the resolution of this protracted litigation that will be harmed by a stay and that the public interest will be disserved by the further delay necessitated by a stay. Accordingly, the parties shall proceed with discovery of the H-series products in the sequenced matter proposed by plaintiff's counsel on the record to minimize the burden and any arguable prejudice to defendant pending the resolution of its objections. The parties shall promptly meet and confer regarding the specific nature of plaintiff's requests for technical and sales documents regarding the H-series products so that defense counsel can confer with his client regarding the length of time needed to produce responsive documents. Defendants reported that they must depose four experts and file a reply brief "within five days" (now four) unless the Court extends the schedule. Defendants seek an 11-day extension of the schedule so that they can depose the four experts in an orderly manner. On Wednesday, September 16, Motorola suggested deposing three of the experts today (i.e., Thursday), tomorrow, or Saturday (see Dckt. No. [184-3]), even though Motorola tendered their declarations on Monday. The motion also states that Motorola had three weeks to prepare for the deposition of Hytera's expert (Dr. Akl), but Hytera now has only a few days to prepare for the depositions of Motorola's four experts. Maybe there is another side to the story. If so, Motorola Solutions shall file a response by noon tomorrow. If there is a concrete reason why an extension of less than two weeks is problematic, Motorola must explain why. Docket Text: ORDER In light of the public health situation, the Court encourages all parties and their counsel to take precautions, be reasonable, and use common sense in pending cases. In General Order No. 20-0012 dated March 16, 2020 (and amended on March 17), the U.S. District Court for the Northern District of Illinois extended all deadlines in civil cases by three weeks. Parties should assume that this Court will accommodate reasonable requests for extensions in the coming weeks, and counsel should show flexibility and accommodate each other too. This Court will grant a six-week extension of fact discovery if requested (and there is no need for an immediate request). Parties should not take depositions before April 17 unless (1) they take place telephonically; and (2) all parties and the witness(es) consent. Even a telephonic deposition often requires an in-person meeting to prepare the witness, so telephonic depositions can go forward only if everyone agrees. If any party or witness wants a deposition to take place in person, the deposition will take place after April 17. Needless to say, that date may change as the public health situation continues to evolve. Parties should continue to make progress in their cases when possible, but in a manner that is consistent with public health and safety. In the meantime, continue to work together cooperatively in the best traditions of our shared profession. An initial status conference is set for 5/18/2017 at 9:45 a.m. in Courtroom 1725. The parties are advised to review and strictly comply with the Court's standing order concerning initial status conferences and the filing of the initial status report (which, in this case, will be due no later than 5/8/2017). The standing order and the template for the initial status report are available on the Court's homepage at www.ilnd.uscourts.gov. Compliance with this standing order, and all of the Court's standing orders, is expected and required. By way of preliminary information, the Court expects attorneys to appear at all set dates. If an attorney has a conflict with a set date, the attorney must notify Judge Blakey's Courtroom Deputy, Gloria Lewis, at (312) 818-6699. If appropriate, the Court will then reset the matter. Advising opposing counsel of a conflict is not a substitute for communicating with the Court. Attorneys who fail to appear and fail to notify the Courtroom Deputy of any conflict may be subject to sanctions. Additionally, the parties are strongly encouraged to consider consenting to proceed before the assigned United States Magistrate Judge.
