Sep 27, 2023 57 MOTION by Plaintiff ND Products, Inc. for default judgment as to remaining defendants (Keener, Kevin) (Entered: 09/27/2023) (2)
Sep 26, 2023 56 MINUTE entry before the Honorable Franklin U. Valderrama: On 9/20/2023, Defendant JIAYUAN US filed a letter before the Court requesting assistance with unfreezing Defendant's Amazon account pursuant to a settlement reached with Plaintiff 54 . On 9/25/2023, Plaintiff filed a notice of dismissal as to Defendant JIAYUAN US pursuant to Federal Rule of Civil Procedure 41(a)(1), dismissing Defendant JIAYUAN US with prejudice. Accordingly, this case is dismissed as to Defendant JIAYUAN US. The Court understands that the dismissal resolves the concerns raised in Defendant's letter 54 . If that is not the case, Defendant JIAYUAN US should file a motion so informing the Court. However, the Court notes that corporations are not permitted to represent themselves in federal court. See 1756 W. Lake St. LLC v. Am. Chartered Bank, 787 F.3d 383, 385 (7th Cir. 2015) (noting the "requirement that a limited liability company be represented in litigation by a lawyer"), so further filings should be made by counsel. By 10/3/2023, Plaintiff is directed to file any notices of dismissal reflecting the dismissal of any additional defendants and to file an updated motion for default judgment that accounts for additional dismissed defendants. Plaintiff is also directed to send a proposed order accompanying the motion for default judgment to the Court's Proposed Order Inbox. Emailed notice (axc). (Entered: 09/26/2023) (1)
