Given that not all parties have been served and consented to magistrate-judge jurisdiction, the court is resetting the case-management conference to 12/12/2019 11:00 AM in San Francisco, Courtroom B, 15th Floor, to allow service. Generally, the court does not set dates at an initial case-management conference until all parties have been served and either have appeared (and consented to magistrate-judge jurisdiction) or defaulted.

The court does not have enough information to decide definitively whether service is proper on Kollectorsvault, LLC. Possibly discovery will illuminate that issue, but it seems prudent for Panini America, Inc. to try other means of service. Panini has suggested service by publication. Without deciding the issue, and recognizing that the address of record is a P.O. Box, the court generally tries to use alternate methods in addition to publication, such as email if possible. That discovery might also be relevant to serving Kollectorsvault (depending on what the facts are about the company) and might be relevant to the "good cause" needed to extend the time for service. The court asks the parties to confer on a specific discovery plan before their planned mediation (which the parties asked for in 150 days). The court wonders whether that timeline might be advanced (depending on what discovery shows about the appearing defendant).

The court might be missing something but it appears that the appearing defendant did not file a responsive pleading. Again given the appearing defendant's representations, and in aid of minimizing costs, the parties might confer about whether they might agree to stay the filing of an answer until they conduct initial discovery and participate in the mediation.
