| Dec 11, 2024 | 20 | CIVIL CASE MANAGEMENT PLAN AND SCHEDULING ORDER: All parties do not consent to conducting all further proceedings before a United States Magistrate Judge, including motions and trial. 28 U.S.C. § 636(c). Any motion to amend or to join additional parties shall be filed within 30 days from the date of this Order. All fact discovery shall be completed no later than: January 6, 2026, or 60 days after Markman Order, whichever is later. This accounts for the complexity of this case, which involves five patents and multiple accused products and gives the parties adequate time to take fact discovery after the Court's construction of claim terms, including any discovery pursuant to Local Patent Rule 10. Depositions shall be completed by no later than the close of fact discovery. All expert discovery, including expert depositions, shall be completed no later than 90 days after the close of fact discovery or 90 days after the Court's Markman Order, whichever is later. The parties shall be ready for trial 14 days after Joint Pretrial Order (timing will depend on when Markman Order issues). This case is to be tried by a jury. Counsel for the parties have conferred and their present best estimate of the length of trial is 5 days. The Joint Disputed Claim Construction Chart shall be due June 13, 2025. Claim Construction briefing schedule shall be as follows: i. Plaintiff's opening claim construction brief shall be filed July 11, 2025. ii. Defendant's responsive claim construction brief shall be filed August 15, 2025. iii. Plaintiff's reply claim construction brief shall be filed August 22, 2025. Summary Judgment briefing schedule shall be as follows: i. Opening Briefs shall be served within 28 days after close of all discovery. ii. Responsive Briefs shall be served within 28 days after Opening Summary Judgment Briefs. iii. Reply Briefs shall be served within 14 days after Responsive Summary Judgment Briefs. The initial telephone conference scheduled for December 16, 2024 is ADJOURNED. The Court approves and so-orders the parties' proposed schedule. The parties are directed to file a joint status letter by the close of fact discovery-on or before January 6, 2026-addressing (1) the status of fact discovery; (2) whether any party intends to proceed with expert discovery; and (3) any other issues the parties wish to discuss.
