As to plaintiff's motion to dismiss Count III of defendant's amended counterclaims, the court ordered that plaintiff shall serve its motion by July 23, 2019; defendants shall serve their opposition by August 9, 2019; and plaintiff shall serve its reply by August 16, 2019. The court permitted defendant to move for a stay, so long as the motion was fully briefed prior to the already scheduled July 25, 2019 Markman hearing in this case. The court, however, made clear that it was disinclined to grant a stay in light of the substantial expenditures and efforts by the parties leading up to the half-day Markman hearing. The court also questioned whether it would be a waste of judicial and client resources for the court to construe claim terms for a patent that may be found invalid by the Patent and Trial Appeal Board on IPR. Finally, the parties indicated they did not believe it necessary to further amend their respective pleadings in either this case (Popsockets II) or 18-CV-5546 (Popsockets III) to finalize their intended consolidation.
