Nov 16, 2017 N/A ORDER: By letter dated November 6, 2017 (ECF No. 40), defendants' counsel requested this Court's intervention in a discovery dispute concerning specific language in the parties' proposed protective order. By letter dated November 13, 2017 (ECF No. 41), plaintiff filed its response. The Court is inclined to agree with plaintiff that no Patent Office review proceeding has been filed and that, even if such filing had been made, the Patent Office's disclosure rules would apply to proceedings brought in that forum. However, by the rules of this Court, the parties must make a diligent effort to resolve their dispute. (E.D.N.Y. Local Civil Rule 37.3(a).) While defendants state that the parties have made a good-faith effort to resolve the dispute (ECF No. 40 at 1), the Court is not satisfied with the extent of these efforts. Accordingly, the parties are hereby directed to meet and confer by November 22, 2017 to redouble their efforts to resolve this dispute. The parties shall file a joint status letter by November 28, 2017.
