Feb 26, 2020 26 ORDER ON OBJECTION TO REPORT AND RECOMMENDATIONS - Plaintiffs, SREAM, INC. and ROOR INTERNATIONAL BV, filed their Objection to the Magistrate Judges Report and Recommendations ECF No. 25 , which Report and Recommendations ECF No. 23 recommended that the case be dismissed for the Plaintiffs failure to prosecute. On April 4, 2019, the Clerk of this Court entered a default against Defendant Greenwood Discount Tobacco. On August 28, 2019, the Magistrate Judge ordered the Plaintiffs to show cause within seven days why the case should not be dismissed for failure to prosecute. When Plaintiffs failed to do so, the Magistrate Judge subsequently filed a Report and Recommendations to Dismiss Complaint without Prejudice on September 16, 2019. (ECF No. 23). Plaintiffs did not respond until October 30, 2019, when they filed a Motion for Default Judgment ECF No. 24 , and then, on October 31, 2019, they filed their Objection to Report and Recommendations ECF No. 25 , explaining that as a result of miscommunication between Plaintiffs counsel, no motion for default judgment and no response to the show cause order were timely filed. Additionally, because of the miscommunication, a timely objection to the Report and Recommendations was not filed. Plaintiffs ask the Court to excuse their failure to timely file the motion for default judgment and to sustain their objection to the Magistrate Judges recommendation that the complaint be dismissed without prejudice. Because Plaintiffs have now filed a motion for default judgment and are prosecuting this case, a dismissal without prejudice is no longer warranted and would be in efficient. Therefore, the Court sustains the Objection to the Report and Recommendation. ECF No. 25 . The motion for default judgment will be considered separately. Signed by Judge James R. May 7, 2019 20 Uniform Case Management Plan - Plaintiffs Roor International BV and Sream, Inc. filed complaints against several defendants alleging trademark infringement, counterfeiting, and false designation of origin based on the offer of sale and sale of allegedly unauthorized water pipes bearing the RooR trademark. Some defendants have filed counterclaims against plaintiffs seeking declaratory relief regarding the alleged invalidity, unenforceability, and, if applicable, cancellation of the asserted trademark registration. The court determines that the following uniform case management plan is the most efficient way to manage these cases. See Order for deadlines and additional information.
