Jan 6, 2020 13 order on motion to stay (2)
Docket Text: MINUTE entry before the Honorable Marvin E. Aspen: On October 22, 2019, Defendants filed a motion through Defendant Zeb. K. Khan that requested "to please keep this case in abeyance for at least 6 months" due to Khan's September 5, 2019 cancer surgery. (Mot. Dkt. No. 10). The amended complaint alleges that Khan owned and operated Lakeview Tobacco, Inc. d/b/a Lakeview Smoke Shop. (Amend. Compl. (Dkt. No. 6) 8.) Khan states that this delay is necessary because his doctor advised him to rest until he recovers from the surgery. (Id.) Although Plaintiffs do not object to the allowance of additional time for Defendants to seek counsel and respond to the complaint, they do object to the amount of time requested and ask us to enter a shorter time period. (Pls.' Resp. (Dkt. No. 12).) We consider Khan's requested extension of time to respond unreasonably delays the proceedings considering that the initial and amended complaints were respectfully filed in July and August 2019. (Dkt. Nos. 1, 6.) Taking this into consideration, we grant Defendants' motion in part and deny it in part. To the extent it is granted, we grant Plaintiff a total of five months from the date this motion was filed to retain counsel and file a response, until March 24, 2020. The status hearing scheduled for 1/9/2020 is stricken and reset to 3/26/2020. (Dkt. No. 11.) We additionally remind the parties that self-represented litigants are not allowed to represent corporations (even by the owner or an officer) as corporations may only be represented by an attorney. See Northern District of Illinois' Guide for the Pro Se Litigant at 8 (revised September 30, 2016), https://www.ilnd.uscourts.gov/_assets/_documents/_forms/_ProSe/forms/Pro%20Se%20Help%20Packet-English.pdf.
