Civ. P. 65(b), one of the two requirements that a Court needs to issue a TRO without prior notice to an adverse party is that the movant's attorney certifies in writing any efforts made to give notice and the reasons why it should not be required. Here, Plaintiff has not submitted such a document. Additionally, in order for the court to issue a preliminary injunction or a TRO, the movant, Plaintiff in this case, must give security in an amount that the court considers proper to pay the costs and damages sustained by any party found to have been wrongfully enjoined or restrained. Fed. R. Civ. P. 65(d). Plaintiff has not filed a proposed amount for security under Rule 65(d) for the Court to consider. Accordingly, the Court ORDERS Plaintiff to provide an affidavit in compliance with Rule 65(b)(1)(B) and a proposed security amount under Rule 65(d). Given that the filing of a TRO is a serious matter the Court ORDERS Plaintiff to respond by tomorrow August 10th 2017, no later than 5 p.m. local time.
