Feb 6, 2023 98 ORAL ORDER: The Court, having reviewed Plaintiff Satius Holding, Inc.'s ("Plaintiff" or "Satius") motion seeking to lift the stay in this case (the "Motion"), (D.I. 94), and the briefing related thereto, (D.I. 95; D.I. 96; D.I. 97), hereby ORDERS that the motion is GRANTED. "When a court has imposed a stay, but circumstances have changed such that the court's reasons for imposing [that] stay no longer exist or are inappropriate, the court [] has the inherent power and discretion to lift the stay." Princeton Digit. Image Corp. v. Konami Digit. Ent. Inc., Civil Action Nos. 12-1461-LPS-CJB, 13-335-LPS-CJB, 2015 WL 219019, at *2 (D. Del. Jan. 14, 2015) (internal quotation marks and citation omitted). The stay was in place "pending completion of the ex parte reexamination proceedings for [the three asserted claims -- claims 1, 11 and 18 -- of] the '385 patent[.]" (D.I. 86) When considering the three stay-related factors, the Court agrees with Satius that subsequent developments in the reexamination proceedings demonstrate that the stay is no longer warranted. It so concludes for the following reasons: (1) With regard to the simplification factor, the United States Patent & Trademark Office ("PTO") has now confirmed the validity of dependent claims 11 and 18 twice in two separate ex parte reexamination proceedings. (D.I. 92 at 1-2; D.I. 95 at 1) Thus, these claims are ready to proceed here. As for independent claim 1, while it was ultimately confirmed valid in the first reexamination proceeding, it currently stands rejected in the second reexamination proceeding. (D.I. 92 at 1-2) Satius' response to the non-final office action in the second proceeding was due by January 29, 2023. (Id. at 2; D.I. 95 at 1 n.1) The elements of claim 1 are necessarily part of claims 11 and 18, and so proceeding with the litigation now would not result in wasted effort, even if the rejection of claim 1 continues to stand. (D.I. 95 at 1; see also 96 at 1) And Defendants Samsung Electronics Co., Ltd. and Samsung Electronics America, Inc. ("Defendants" or "Samsung") have not persuaded the Court that the remainder of the second proceeding regarding claim 1 will have a meaningful impact on what must still occur here, such that the stay should remain in effect on "simplification" grounds. See MG FreeSites Ltd. v. Scorpcast, LLC, Case No. 20-1012-MFK, D.I. 177 at 3, (D. Del. Oct. 5, 2022) (granting a request to lift a stay where, inter alia, the court was "not persuaded that a continued stay is likely to simplify the issues for trial to any significant extent, at least not in a way that outweighs the prejudice to [the plaintiff] that a continued stay would cause"). Instead, Samsung spends much of its brief setting out how "significant simplification" has already occurred and vaguely positing that "[k]eeping the stay in place will continue to simplify the issues in this litigation." (D.I. 96 at 1-2) Although Samsung suggested that Satius' response to the Examiner's rejection of claim 1 could have an impact on claim construction, (id.), that response was due by January 29, 2023, and so Samsung may utilize any arguments made in that response here if it wishes.; (2) With regard to the status of the case and undue prejudice factors, this case was filed over four and a half years ago. (D.I. 1) Before the stay, the parties were on the cusp of the Markman hearing; since the stay, the case has been dormant for over three years. (D.I. 95 at 2) Defendants shot their shot in the PTO in an effort to knock out all of the asserted claims, and all these years later, they have so far come up short. At a certain point, after such a long delay has transpired and the patentee still has some viable claims that are going to go forward in federal court no matter what, outsized delay of this type starts to become fundamentally unfair to a party like Satius, who understandably wants to obtain timely relief for alleged patent infringement. See Fed. R. Civ. P. 1; cf. MG FreeSites Ltd., D.I. 177 at 3. At this point, it is time to get the case moving again.; and (3) The stay of the case is hereby LIFTED. By no later than February 17, 2023, the parties shall meet and confer and submit a proposed amended Scheduling Order that addresses the remainder of the case. The proposed amended Scheduling Order shall be consistent with Judge Burke's form "Rule 16 Scheduling Order -- Patent" up through and including paragraph number 16 (i.e., regarding the portions of the case schedule leading up to but not including the case dispositive motion stage of the case) and consistent with paragraphs 15-22 of Judge Noreika's "Patent Scheduling Order -- Non-ANDA" (i.e., regarding the portions of the case schedule from the case dispositive motion stage through post-trial motions). Both Scheduling Orders can be found on Judge Burke's/Judge Noreika's portions of the District Court's website. If there are disputed issues between the parties regarding the content of the proposed amended Scheduling Order, the parties should note those areas of dispute in the proposed amended Scheduling Order, along with their proposals for the language the Court should adopt as to that issue. In addition, the parties may each separately file a letter (of no more than two single-spaced pages) setting forth their position as to these disputed issues. Ordered by Judge Christopher J. Docket Text: ORAL ORDER: The Court, having reviewed Defendants' motion to stay pending competition of ex parte reexamination proceedings for U.S. Patent No. 6,711,385 (the "'385 patent") ("motion"), (D.I. 73), and the briefing related thereto, (D.I. 74; D.I. 77; D.I. 81), which only recently concluded on December 5, 2019, and having considered the three stay-related factors, hereby ORDERS that the motion is GRANTED and that the case is STAYED pending completion of the ex parte reexamination proceedings for the '385 patent. The simplification of issues factor slightly favors a stay. The United States Patent and Trademark Office ("PTO") granted Defendants' request for ex parte reexamination of all three asserted claims of the 385 patent. (D.I. 74 at 1) To be sure, the PTO will not take up all of the issues that are at play in this case. But with all of the asserted claims at issue there, there is the real prospect that the parties and the Court could engage in a significant amount of work going forward, only to have the PTO end up eliminating all claims at issue (or otherwise issuing decisions that could have a significant impact on the invalidity case). And while it is true that if Plaintiff prevails in the reexamination proceeding, Defendants will not be estopped from raising the same invalidity issues here, the Court would then at least have the benefit of the PTO's views on the prior art (including as to the '980 PCT publication issue, which seems a key invalidity issue in the case). That could help focus and streamline the Court's review of issues surrounding that art later in this litigation. The status of the case factor is either neutral or slightly favors a stay, as: (1) While we are not at the beginning of the case schedule, and a not-insignificant amount of work has been put into the case, there are also many substantial milestones still ahead (i.e., the Markman hearing and the issuance of claim construction decisions, fact deposition-related discovery, expert discovery, summary judgment).; and (2) As document discovery has concluded, the parties are at a good "stopping point" where they can await the resolution of the reexamination proceeding and then proceed forward toward trial (if necessary). See 360Heros, Inc. v. GoPro, Inc., Civil Action No. 17-1302-LPS-CJB, D.I. 132, (D. Del. June 5, 2019); Ethicon LLC v. Intuitive Surgical, Inc., C.A. No. 17-871-LPS, 2019 WL 1276029, at *2 (D. Del. Mar. 20, 2019). Lastly, the undue prejudice factor weighs in favor of a stay. Most significantly, the parties are not direct competitors and Plaintiff will be able to seek monetary damages to fully compensate it for infringement occurring between now and when a stay ends. As to the other undue prejudice subfactors, they are a mixed bag. With regard to the timing of the ex parte reexamination request, Defendants did wait 15 months until after Plaintiff filed this action to file their request for reexamination. (D.I. 77 at 5) And during this timeframe, the parties have engaged in a significant amount of work relating to discovery and claim construction. However, Defendants make a good case that Plaintiff's litigation choices are partly responsible for some of this filing delay, as Plaintiff made Defendants seek Court intervention in order to get a substantive response to Defendants' invalidity contentions. (D.I. 52) Had Plaintiff served a sufficient response months earlier, Defendants presumably would have moved sooner to institute a process for review of the asserted claims by the PTO. With regard to the timing of the stay request, Defendants sought a stay soon after reexamination was granted, which helps their motion. And as for the status of the reexamination proceeding, the proceeding is at a relatively early stage, but the PTO has moved quickly so far and an office action is expected to be issued in the next few months (at the latest) with regard to all asserted claims. (D.I. 74 at 8) Thus, the undue prejudice factor (particularly in light of the lack of direct competition), ultimately favors a stay. Ultimately, though the issues are not lopsided, a stay makes sense here. The parties and the Court are on the precipice of a significant new stage of work in the case as to asserted claims that may well be found invalid at the PTO. Although the case is now stayed, if a party believes that subsequent developments in the reexamination proceeding suggest that a stay is no longer warranted, it may communicate with the Court by letter with a request to brief that issue. Otherwise, the parties shall jointly notify the Court by letter within 10 days of the conclusion of the reexamination proceeding. Ordered by Judge Christopher J. Burke on 12/11/2019. (dlb)

By no later than August 22, 2019, Plaintiff shall provide Defendants with supplemental responses relating to its claims for damages based on the information currently available to it. (2) With respect to Interrogatory No. 10, Defendants' Motion is GRANTED. Plaintiff now has an understanding of the scope of this Interrogatory that is not redundant with Interrogatories 7 and 8 (i.e., that it is asking for a description of communications regarding how this lawsuit might be valued). By no later than August 22, 2019, Plaintiff shall provide Defendants with a supplemental response that identifies any responsive, non-privileged communications. (3) With respect to Interrogatory No. 11, Defendants' Motion is DENIED AS MOOT. Plaintiff has represented that it has not identified any responsive information to date. However, because Defendants did not chart out (or otherwise articulate) in any specific way their proposed obviousness combinations, Plaintiff need not respond now as to why each of these numerous (i.e., "hundreds, if not thousands") of possible combinations fail to render the claims invalid.
