Jan 31, 2018 N/A Order on Motion for Permanent Injunction (0)
Docket Text: ORDER: The Stipulated Motion for Preliminary and Permanent Injunction [19] filed by Plaintiff is DENIED WITHOUT PREJUDICE for the following reasons. First, as the Court has previously noted, Defendant Advanced Skincare, LLC cannot appear or take any action before the Court except through counsel. It certainly cannot waive service, consent to jurisdiction, or stipulate to injunctive relief. Second, Plaintiff's Motion and proposed Order are unsupported by any factual or evidentiary submission and contain only conclusory arguments and proposed findings regarding the factors which the Court must consider before entering an injunction. While the parties are free to enter into whatever private agreements they wish, the parties' agreement is not sufficient for the Court to exercise its equitable injunctive powers. The Court will not entertain a request for an injunction on a bare record. Any re-filed motion must be supported by cognizable evidentiary submissions and make a meaningful showing as to each of the factors which the Court is required to consider under Rule 65 before entering an injunction. Plaintiff's counsel is DIRECTED to provide a copy of this Order to the Defendants. SO ORDERED by Judge William J. Martinez on 1/31/2018. Text Only Entry (wjmlc2, )

Jan 26, 2018 N/A Order on Motion for Extension of Time to File (0)
Docket Text: ORDER as to [21] Plaintiff's Unopposed Motion to Extend Deadline: Given the stipulated motion signed on January 22 and filed earlier yesterday [19], the Court does not view Plaintiff's Motion for an Extension of Time, filed last night, as having been filed "as far in advance of the deadline... as possible," as required by WJM Practice Standards II.D.2 (as most recently revised effective December 1, 2017). Nevertheless, given the parties' likely settlement, Plaintiff's Motion [21] is GRANTED in that the Court VACATES its prior Order directing Plaintiff to re-file an Amended Motion for Preliminary Injunction by today. Given the circumstances, the Court will not set any deadline for re-filing such a motion, although any undue delay in seeking relief under Rule 65 may weaken Plaintiff's claims of urgency and irreparable harm. SO ORDERED by Judge William J. Martinez on 1/26/2018. Text Only Entry (wjmlc2, )
