Oct 3, 2023 67 MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Daniel J. Albregts on 10/3/2023. Re: 65 Stipulation to set expedited briefing schedule. The parties stipulate to an expedited briefing schedule for Plaintiffs' motion to compel and Defendants' counter-motion for protective order. The purpose of the expedited schedule is so that the Court can "expeditiously rule on these motions," so that "depositions are not delayed." The parties suggest that their motions be fully briefed on Friday, October 13th so that the Court can issue a decision by Tuesday, October 17th, giving the Court one day to rule on the motions. The Court is unable to issue a decision within the one-day timeframe that the parties request. Moreover, the Court does not find scheduling depositions to constitute an emergency such that expedited relief is necessary. See LR 7-4(c) (explaining that the court may determine whether any matter submitted as an "emergency" is, in fact, an emergency). Additionally, while the Court appreciates that the parties have stipulated, their stipulation seeks emergency relief without otherwise following the requirements for filing an emergency motion. See LR 7-4. The parties are free to agree to an expedited briefing schedule. But the Court will not approve a request for the Court to act on an emergency basis that fails to comply with the Local Rules and fails to provide a robust explanation why the Court should decide the issue before other pending motions. Because the instant stipulation fails to do both, the Court denies it. IT IS THEREFORE ORDERED that the parties' stipulation to set expedited briefing schedule 65 is DENIED.
