For the reasons stated on the record, the Joint Motions for Protective Order at DE 38 in 22-cv-00123 ("Slingshot I") and DE 32 in 22-cv-01852 ("Slingshot II") are DENIED WITHOUT PREJUDICE. The Court rejects Defendants' request that the protective order include limits on the number of pages of mask files that can be produced. As to the dispute concerning the scope of Attorneys' Eyes Only or Confidential Information access, the parties shall meet and confer and propose a revised protective order to the Court. The Court issues these orders pursuant to its broad discretion under the Federal Rules of Civil Procedure to manage discovery. See, e.g., Wood v. F.B.I., 432 F. 3d 78, 34 (2d Cir. 2005) (recognizing that courts have "broad discretion to manage pre-trial discovery"). The parties shall submit a final proposed protective order to the Court or advise on any outstanding protective order disputes by 11/2/2022. Regarding the parties' dispute over the timing of exchange of "final contentions" (as set forth in DE 44 in Slingshot I and DE 34 in Slingshot II) the Court GRANTS Defendants' request to set a date for service of final contentions after claim construction and before the close of fact discovery, allowing leave for each side to seek leave from the Court to modify as necessary. See Convolve, Inc. v. Compaq Computer Corp., No. 00 CIV. 5141 (GBD)(JCF), 2006 WL 2527773, at *1 (S.D.N.Y. Aug. 31, 2006). The parties shall meet and confer and submit a revised proposed schedule by 11/2/2022. Regarding any current stay on discovery, the Court hereby lifts the stay on discovery previously ordered in Slingshot II by the Court on 9/19/2022 and confirms that there is no current stay on discovery in Slingshot I or Slingshot II. The Court GRANTS the Motion for a pre-motion conference at DE 37 in Slingshot I to the extent the parties shall file further briefing (in letter motions no longer than five pages each) on a stay of discovery. Defendants shall file their letter motion by 11/2/2022 and Plaintiffs shall respond by 11/16/2022. The parties shall submit a joint status report by 1/18/2023. The Court will hold a Status Conference on 2/15/2023 at 11:00AM via Zoom. The Court will email the Zoom invitation closer to the conference date. SO ORDERED by Magistrate Judge Lee G.
