Apr 20, 2021 N/A ORDER: The Court declines to enter the stipulation 51 staying this matter pending the resolution of two other matters in two other Districts which are on different discovery schedules. The parties contend that discovery in the various cases overlap; if so, the proper course would be to agree to use the discovery in one or both of the other cases in this case. To the extent that the parties believe that litigating this case while the other cases are pending would lead to inconsistent judgments, the proper course would be for Plaintiff to dismiss this case without prejudice; the parties to enter into a tolling agreement on the statute of limitations, if appropriate; and refile this case, if necessary. Plaintiff chose to file this action in this District; the mere existence of other litigation in other districts does not counsel a stay of this action, unless there was a settlement pending that would resolve all three matters in one stroke. But that is not the situation here, where the parties wish to continue litigating elsewhere, but not here, and simply place this case in suspension. Doing so--without knowledge of the resolution of those other cases, which cannot be known at this time--risks that this case restarts in months or years, thereby delaying ultimate resolution. The Court does not countenance such an approach. The stipulation is rejected, the motion to stay is denied, and the Rule 16 schedule in this case remains operative. Mar 18, 2021 N/A ORDER: Plaintiff's motion for leave to file a belated answer to Defendant's counterclaims 49 is granted. Plaintiff has established that the factors set out in Enron Oil Corp. v. Diakuhara, 10 F.3d 90, 96 (2d Cir. 1993), namely "(1) whether the default was willful; (2) whether setting aside the default would prejudice the adversary; and (3) whether a meritorious defense is presented," weigh in favor of granting the motion. First, Plaintiff has established that its default was not willful, but the result of attorney negligence. See, e.g., Am. Alliance Ins. Co. v. Eagle Ins. Co., 92 F.3d 57, 61 (2d Cir. 1996) (finding that vacatur of a default was justified where the default was caused by "a filing mistake" by defendant's in-house legal department). Second, the Court finds that Defendant will not be prejudiced by the short delay. GEICO v. Jacobson, No. 15-CV-7236, 2019 WL 10959842, at *3-4 (E.D.N.Y. Oct. 15, 2019) (finding no prejudice following a "one-month delay"), report and recommendation adopted, Order (Nov. 6, 2019). And third, Plaintiff indicates that it is promptly prepared to file an answer, which denotes that a meritorious defense may be present; the Court's preference is to resolve cases on the merits, not on default. For these reasons, Plaintiff's motion is granted, and it shall file its answer as a separate docket entry by 3/22/2021. The Clerk of Court will deny Defendant's request 48 for entry of default. Jan 4, 2021 N/A ORDER: The motion for extension of time to file answer 40 is granted. Defendant Jomashop Inc. ("Defendant") has established that the factors set out in Enron Oil Corp. v. Diakuhara, 10 F.3d 90, 96 (2d Cir. 1993), namely "(1) whether the default was willful; (2) whether setting aside the default would prejudice the adversary; and (3) whether a meritorious defense is presented," weigh in favor of granting the motion. With respect to the first factor, Defendant argues that the default was not willful but, instead, the result of a mistake by counsel. Namely, counsel states that he "did not see" that new counsel had appeared on behalf of Plaintiff, (Dkt. No. 42 11-12), and thus assumed "that Plaintiff would be unrepresented and that the action would likely be dismissed," (Dkt. No. 41 at 10-11). While Defendant acknowledges it was aware of its obligation to respond to the Complaint and instead chose not to, "bearing in mind the strong preference for resolution of disputes on the merits, the Court concludes that this may not be the sort of 'willfulness' and 'bad faith'" that justifies entry of default. Miller v. Experian, 183 F.R.D. 364, 369 (E.D.N.Y. 1998) (finding that, although a defendant was "[a]t the very least,... negligent and deliberately indifferent," its conduct was not willful). With respect to the second factor, the Court also finds that, although Plaintiff has not consented to the extension, it will not be prejudiced where the delay was "only a day or so." Enron Oil Corp., 10 F.3d at 97. And with respect to the third and final factor, Defendant is prepared to promptly file an answer and continue with litigation, which indicates that a meritorious defense may be present. For these reasons, Defendant's motion is granted, and Defendant shall file its answer by 1/8/2021. So Ordered by Magistrate Judge Sanket J. Bulsara on 1/4/2021.
