Docket Text: MINUTE entry before the Honorable Franklin U. Valderrama: Telephonic status hearing held on 09/24/2021. Counsel from both parties appeared via telephone. First, for the benefit of Plaintiff's counsel, the Court repeated the disclosure it provided at the 07/19/2021 hearing. The Court disclosed on the record that one of the Court's law clerks previously represented Plaintiff Republic Technologies (NA) as an associate attorney at a prior law firm. The Court further explained that the law clerk has been and will continue to be walled off from this case entirely; meaning, the law clerk will not participate in any discussions involving the case and will not be reviewing any motions or anything else regarding this case. Given the disclosure, the Court asked if Plaintiff's counsel objected to the Court continuing to preside over this case. Plaintiff's counsel stated on the record that he had no objection to the Court continuing to preside over this case. Second, the Court notified Plaintiff's counsel that his contact information was inaccurate, including his email address and mailing address. The Court advised Plaintiff's counsel to file a Notification of Change of Attorney Address Form (https://www.ilnd.uscourts.gov/_assets/_documents/_forms/_online/ChangeAddressForm2007.pdf) by 5:00 p.m. today. Additionally, the Court directs Plaintiff's counsel to update his contact information in the settings for his CM/ECF account. Third, Plaintiff's counsel updated the Court that the parties have reached a settlement and would like to dismiss the case. Based on this representation and confirmation from Defendant's counsel, the Court dismisses the case without prejudice with full leave to reinstate via motion filed by 11/08/2021. If no motion to reinstate is filed by that date, then the dismissal will automatically convert to a dismissal with prejudice, without further action by the Court. The Court advises the parties that, generally speaking, Seventh Circuit decisions hold that dismissals "with prejudice" leave the Court without jurisdiction to enforce a settlement agreement. See Shapo v. Engle, 463 F.3d 641, 646 (7th Cir. 2006). This civil case is terminated. Mailed notice (axc).
