That will be referred to a magistrate judge. The second part is the more traditional failure to state a claim. It only involves one of the two asserted patents. It appears to be agreed that Plaintiff is not claiming that it has a claim for induced infringement before service of the original complaint. Service of the original complaint provides notice of the patent and therefore provides a basis for knowledge of the patent. The claim of induced infringement was not in the original complaint. There was a claim chart with the original complaint that relates to direct infringement. That claim chart appears to be unchanged in the first amended complaint. Direct infringement continues to be alleged in the first amended complaint. I think the first amended complaint provides a plausible basis for concluding that Defendant indirectly infringes.
