Nov 17, 2021 N/A MINUTE ENTRY AND ORDER: A status conference was held on 11/17/2021 before Magistrate Judge Sanket J. Bulsara. Counsel for all parties were present. As stated on the record, the parties are hereby directed to file a joint submission with a schedule for the completion of discovery previously served and for motion to compel and/or motion for sanctions practice by 11/23/2021. If the parties cannot agree on such a schedule, they are to jointly file their respective proposals. The parties may file a request on the docket for the Court to hold a settlement conference if they determine it would be fruitful. So Ordered by Magistrate Judge Sanket J. Bulsara on 11/17/2021. (AT&T Log: 2:18 - 2:48 P.M.) (Bruckner, Ian) (Entered: 11/17/2021) (0)
Oct 20, 2021 N/A ORDER: The Court rejects the parties' proposed schedule 75 . The Court will not adopt a hypothetical or conditional discovery schedule premised on yet to be filed and undisclosed discovery motions. Indeed, the Court will not permit discovery motions to be filed after the close of fact discovery. And furthermore, discovery served on the final date of fact discovery is not timely. "The discovery deadline date is the date on which discovery should be complete; it is not the last date on which a party can serve discovery requests." Jones v. Hirschfeld, No. 01 CIV. 7585, 2003 WL 21415323, at *4 n.13 (S.D.N.Y. June 19, 2003) (quotations omitted). The motion is therefore denied. The parties may submit a proposed schedule for the completion of expert discovery only that extends the current schedule, but for the schedule extension to be granted, they must establish good cause for the extension. So Ordered by Magistrate Judge Sanket J. Bulsara on 10/20/2021. (Bruckner, Ian) (Entered: 10/20/2021) (0)

Any objections to this R&R must be filed by 3/12/2021. P. 72(b)(2); Caidor v. Onondaga County, 517 F.3d 601, 604 (2d Cir. 2008) ("[F]ailure to object timely to a magistrate [judge's] report operates as a waiver of any further judicial review of the magistrate [judge's] decision."). Jan 9, 2019 41 SUPPLEMENT to 39 Order,,,,,, Defendants' Supplemental Briefing Pursuant to Order [DE 39] by Loews Miami Beach Hotel Operating Company, Inc., Snappyscreen, Inc. (Fischer, Ury) [Transferred from Florida Southern on 2/12/2019.] (Entered: 01/09/2019) (7)
Dec 21, 2018 39 PAPERLESS ORDER. Pursuant to the patent venue statute, 28 U.S.C. 1400(b), "[a]ny civil action for patent infringement may be brought in the judicial district where the defendant resides, or where the defendant has committed acts of infringement and has a regular and established place of business." "[A] domestic corporation resides only in its State of incorporation for purposes of the patent venue statute." TC Heartland LLC v. Kraft Foods Group Brands LLC, 137 S.Ct. 1514, 1517 (2017). Defendant Snappyscreen, Inc. ("Snappyscreen") is incorporated in Delaware. Accordingly, it "resides" in Delaware and an action for patent infringement against Snappyscreen would be proper in Delaware. Snappyscreen, however, asks the Court to transfer Plaintiff's claims against it to the Eastern District of New York. According to the declaration submitted in support of its Motion to Sever and Transfer, Snappyscreen's principal place of business is in New York. But transfer to the Eastern District of New York is only proper if the Court finds that Snappyscreen has committed acts of infringement and has a regular and established place of business in that district. See 1400(b). The Complaint does not allege any acts of infringement outside the Southern District of Florida. The parties, therefore, are directed to submit supplemental briefing on whether the Eastern District of New York is an appropriate venue for Plaintiff's claims against Snappyscreen. The parties shall file their supplemental briefs, not to exceed five pages, on or before January 9, 2019. Signed by Judge Darrin P. Gayles (hs01) [Transferred from Florida Southern on 2/12/2019.] (Entered: 12/21/2018) (0)
