The Complaint sufficiently pleads both claims to establish liability as a matter of law. See City of New York v. Mickalis Pawn Shop, LLC, 645 F.3d 114, 137 (2d Cir. 2011) ("[A] district court is required to determine whether the plaintiff's allegations establish the defendant's liability as a matter of law."). The Complaint adequately alleges that the Ruby Sliders trade dress is non-functional, 15 U.S.C. § 1125(a)(3), and that there is a highlikelihood of confusion with Defendant's product, which appears virtually identical to Plaintiff's product, except that Defendant's product is of a lower quality. See Tiffany & Co. v. Costco Wholesale Corp., 971 F.3d 74, 84-85 (2d Cir. 2020) (apply Polaroid factors). An order of reference to Magistrate Judge Cott for a damages inquest has issued separately.
