At the outset, the Court finds, based on the argument and supporting exhibits in defendant's reply brief, see [234, 234-1, 234-2, 234-3], that defendant has satisfied L.R. 37.2 regarding the first two categories of documents at issue in the motion to compel. On the merits, the Court first concludes that defendant has established that its RFPs and interrogatories seeking documents and information related to the functionality of plaintiff's breast pump are relevant. Plaintiff completed its document production on 07/31/2023, but defendant maintains that plaintiff produced no documents relating to the functionality of the breast pump, including documents relating to the '574 application, which is an international utility patent application for an integrated breast pump that is assigned to an entity owned by plaintiff's principal. The Lanham Act does not protect trade dress elements that are functional, and one relevant factor in deciding whether a trade dress element is functional is "the existence of a utility patent, expired or unexpired, that involves or describes the functionality of an item's design element." Bodum USA, Inc. v. A Top New Casting Inc., 927 F.3d 486, 492 (7th Cir. 2019). Documents relating to the '574 application are therefore relevant because that patent allegedly describes features of a breast pump that are very similar to features of plaintiff's breast pump as functional, which would support defendant's position that plaintiff's trade dress is not protected. Plaintiff's arguments to the contrary, see 222 4-8, go to the weight that a factfinder should give to any such similarities or lack of similarities, not to whether the evidence is discoverable. The customer complaints that defendant seeks are also relevant, as they could establish that plaintiff modified the breast pump, including elements that constitute its trade dress, after consumers lodged complaints about the functionality of the pump. And while plaintiff claims it would be "pointless" to produce these complaints in light of the other discovery that has already been produced to defendant, 222 9, plaintiff does not argue that the request is not proportional to the needs of the case or unduly burdensome. Cf. Tri-State Hosp. Supply Corp. v. United States, 226 F.R.D. 118, 126 (D.D.C. 2005) ("There areonly a finite number of pertinent events in any lawsuit, and how they occurred is a topic that may be pursued by all forms of discovery, even though the information provided by one form of discovery repeats and duplicates information yielded by another."). Accordingly, the motion to compel is granted as to defendant's requests for documents and information relating to the functionality of plaintiff's breast pump, and plaintiff is ordered to respond to these requests within 14 days of the date of this order or to certify that all responsive documents in its possession, custody, or control have already been produced. See F.D.I.C. v. Belongia Shapiro & Franklin, LLP, No. 12 C 2889, 2012 WL 5877559, at *3 (N.D. Ill. Nov. 19, 2012) ("The Court therefore directs BSF to produce all documents responsive to these requests, or if no additional documents exist, to certify that it has produced everything it has that is responsive to these requests."). Second, defendant's motion is denied to the extent that it seeks to compel plaintiff to search for and produce responsive documents in the possession, custody, or control of the related Shumax entities based on plaintiff's representation that it has already searched for such documents and produced all relevant and responsive documents. See 222 9-10. Plaintiff is ordered to certify that it has searched for and produced all responsive documents in its and the Shumax entities' possession, custody, or control. Third, the Court concludes that the parties have not reached an impasse on defendant's request for financial documents. To begin, defendant has not established that it adequately met-and-conferred with plaintiff about its request for documents showing amounts spent on advertising, plaintiff's revenue and profits, sales of plaintiff's breast pumps by plaintiff and third parties, plaintiff's wholesale and retail, and plaintiff's manufacturing costs. The email correspondence on which defendant relies appears to relate only to its separate request that plaintiff make Rule 26(a) disclosures relating to lost-profits damages and produce any documents underlying the request for lost-profits damages. See [234-3] 3. Furthermore, plaintiff disputes defendant's claim that it failed to produce these financial documents and cites to several places in its document production to demonstrate that these documents have already been produced. See 222 12. Finally, the Court observes that, when plaintiff filed its opposition brief, it was "in the final stages of determining whether it will retain an expert to compute" lost-profits damages, and that it "would produce all relevant documents provided to the expert to make such a computation." Given the lack of clarity on the meet-and-confer question and on what financial documents plaintiff has produced, as well as the ongoing discussions about the lost-profits damages, the parties must further meet and confer about defendant's request for financial documents and work in good faith to complete document discovery on this issue. The motion to compel is denied on this issue without prejudice to renewal if the parties cannot resolve the issue despite completely exhausting their meet-and-confer obligations. On the Court's own motion and in light of the ruling on the motion to compel, the Court strikes the 11/15/2023 fact discovery cutoff 236 and resets the 11/17/2023 joint status report deadline 238 to 11/21/2023. Barnes-Staples v. Murphy, No. 20-cv-3627, 2021 WL 1426875, at *2 (N.D. Ill. Apr. 15, 2021). The Court concludes that plaintiff is entitled to the underlying financial data, not just summaries. Summaries are generally inadmissible evidence unless access is provided to the underlying documents from which the summaries have been prepared. See Last Atlantis Capital LLC v. AGS Specialist Partners, 262 F.Supp.3d 641, 679 (N.D. Ill. 2017) (citing Fed. R. Evid. 1006). "If the evidence rules themselves reflect the lack of trustworthiness of summaries of undisclosed documents, it would seem unwarranted to prevent a party-opponent in litigation from discovering the same type of information in order to verify that the summaries are accurate." Kehoe Component Sales, Inc. v. Best Lighting Prods., Inc., No. 2:08-cv-752, 2010 WL 596501, at *4 (S.D. Oh. Feb. 16, 2010); see also Fellowes, Inc. v. Defendants invoke "the so called 'apex doctrine'" in support of their motion to compel. Donald v. City of Chicago, No. 20 C 6815, 2022 WL 621814, at *1 (N.D. Ill. Mar. 3, 2022). This line of authority recognizes that "[c]ourts may protect high-level executives from being deposed when any of four circumstances exist: (1) the official has no unique personal knowledge of the matter in dispute; (2) the information can be garnered from other witnesses or (3) other discovery methods; and (4) sitting for the deposition would impose a hardship in light of the officer's duties." City of Rockford v. Mallinckrodt ARD, Inc., Case Nos. 17 CV 50107 & 20 CV 50056, 2020 WL 1675593, at *2 (N.D. Ill. Apr. 6, 2020) (internal quotation marks omitted). As decisions from the Northern District of Illinois have recognized, "what has colloquially come to be known as the apex 'doctrine... is not a doctrine in the strict sense of the word at all," nor is it "an ironclad rule." Donald, 2022 WL 621814, at *1. Rather, in deciding whether to spare high-level government or corporate officials from a deposition, courts are "sensitive[e] to the risk that very valuable executive time would be wasted where the officer has no real information." Id. (internal quotation marks omitted). Deciding whether to block such a deposition "ultimately involves an exercise of the court's vast, unquestioned discretion." Id.; see also Diamond Servs. Mgmt. Co. LLC v. C&C Jewelry Mfg., Inc., 2022 WL 4466076, at *16 (N.D. Ill. Sept. 26, 2022) ("magistrate judges enjoy extremely broad discretion in controlling discovery") (internal quotation marks omitted). A court addressing an apex-deposition objection should be mindful that "[c]ompletely prohibiting a deposition is an extraordinary measure," Mallinckrodt, 2020 WL 1675593, at *2 (internal quotation marks omitted), while also taking care not to shift the burden onto the party seeking to depose an apex witness. See id. (burden of party seeking protective order "does not shift simply because a party seeks to prevent the deposition of an apex witness"); see also Nucap Indus. Inc. v. Robert Bosch LLC, 2017 WL 6059770, at *2 (N.D. Ill. Dec. 7, 2017) ("Rather than shifting the burden to the party seeking discovery," apex doctrine "merely acknowledge[s] that when weighing the value of the material sought against the burden of providing it, courts may consider an employee's apex position and whether less burdensome alternatives are available") (citing Patterson v. Avery Dennison Corp., 281 F.3d 676, 681 (7th Cir. 2002)). As the Court reads plaintiff's opposition to the motion 217 , the fact is that plaintiff is willing to make Ms. Zhang, a co-owner of Think Green Limited, available for either a remote deposition or an in-person deposition in her home country of New Zealand. See [213-1] 2 (meet and confer email correspondence confirming that Think Green is willing to present Ms. Zhang for a remote deposition), 217 8-9 (opposition brief confirming that Ms. Zhang will agree to sit for an in-person deposition in New Zealand). This fact calls into question the applicability of the Apex factors, as this is not a situation in which Think Green is unwilling to make Ms. Zhang available for a deposition. Here, Ms. Zhang does not wish to leave her special needs child for whom she is the primary caregiver in order to travel for a deposition to occur in Chicago. [217-1]. If defendants are so concerned for the reasons cited in their motion as to the need for this deposition to take place in person, then they may pay their own costs and travel to New Zealand to depose Ms. Zhang. But the Court finds no basis to order plaintiff to pay the defense's travel expenses to the extent defendants wish to pursue an in-person deposition of Ms. Zhang in New Zealand, as the reasons cited by defendants in support of the in-person deposition are speculative at best in the Court's view.
