Aug 26, 2025 8 PAPERLESS ORDER granting 7 Motion for Subpoena. In this patent-infringement action, the Plaintiff has moved "for an order authorizing plaintiff to issue a subpoena for documents and information to Amazon.com, Inc. and/or its subsidiaries identifying the persons or entities who are responsible for the infringing activity alleged in the complaint and determine the amount of the defendants' sales[.]" Motion at 1. The Plaintiff explains that it "needs the identifying information Amazon.com possesses about this seller in order to serve process on the defendant. Plaintiff also needs to determine the amount of sales the defendant sold accurately and the best source for that information is Amazon." Id. at 5. "Federal courts allow parties to conduct expedited discovery in advance of a Rule 26(f) conference where the party establishes 'good cause' for such discovery." Tracfone Wireless, Inc. v. Adams, 304 F.R.D. 672, 673 (S.D. Fla. 2015) (Turnoff, Mag. J.). Courts in this District have routinely found "good cause" to serve a third-party subpoena "so that a plaintiff may discover the identify of a John Doe defendant" who has infringed on a plaintiff's intellectual property rights. MJ Cap. Funding, LLC v. Doe, 2021 WL 10191651, at *1 (S.D. Fla. Apr. 21, 2021) (Singhal, J.) (quoting Plastic the Move Ltd. v. Doe, 2015 WL 12843767, at *1 (S.D. Fla. Apr. 13, 2015)); see also GoFundMe Inc. v. Does 1-5, 2023 WL 11992385, at *1 (S.D. Fla. Dec. 15, 2023) (Louis, Mag. J.) ("Plaintiff has established good cause to conduct narrow discovery prior to the Rule 26(f) scheduling conference for the limited purpose of ascertaining the true identities of Defendant."). Since the Plaintiff "cannot identify the defendant based on all the information available to plaintiff" and needs Amazon's assistance to "obtain information to facilitate service and identify the extent of the defendants' infringing conduct[,]" Motion at 6, we find good cause for the Plaintiff to serve a third-party subpoena on third-party Amazon.com, Inc. prior to a Rule 26(f) discovery conference. Accordingly, we ORDER that the Plaintiff's Motion for Subpoena [ECF No. 7 ] is GRANTED. The Plaintiff may serve the subpoena attached as Exhibit 1 to its Motion on Amazon.com, Inc.
