| Feb 9, 2021 | 6 | ** TEXT ONLY ORDER **Nearly a year ago, plaintiff Wisconsin Research Technologies LLC filed four cases for patent infringement against defendant Beijing Core-Net Technology Co., Ltd. (Case nos. 20-cv-160-jdp, 20-cv-165-jdp, 20-cv-166-jdp, and 20-cv-167-jdp). Plaintiff still hasn't served defendant in any of the four cases, so the court directed plaintiff to provide an update on service. The 90-day time limit in Federal Rule of Civil Procedure 4(m), doesn't apply to service on foreign corporations, but plaintiff must still show that it is exercising reasonable diligence in attempting to serve defendant. See Astor Chocolate Corp. v. Elite Gold Ltd., No. 18 CIV. 11913 (PAE), 2020 WL 7496342, at *7 (S.D.N.Y. Dec. 21, 2020). In response to the court's order, plaintiff moves for an extension of time until May 5, 2021, to serve defendant. Plaintiff says that defendant is a Chinese company that must be served through the Chinese Ministry of Justice and that the ministry is experiencing a "significant backlog" because of the COVID-19 pandemic. Plaintiff's motion is GRANTED. If plaintiff doesn't file proof of service by May 5, the court will dismiss each of these cases without prejudice to refiling them at a later date.
