Thereafter, Plaintiff, by leave of the Court, filed a Second Amended Complaint (d/e [36]), which joined an additional defendant and alleged substantially the same claims against Lowe's as did the First Amended Complaint. On March 31, 2021, Lowe's filed a motion to dismiss or transfer directed towards Plaintiff's Second Amended Complaint. See d/e [42]. Lowe's motion to dismiss the Second Amended Complaint, and the briefs filed in support thereof, are substantially identical to the briefs and motion directed towards Plaintiff's First Amended Complaint. Ordinarily, the filing of an amended pleading renders any motion attacking the original pleading moot pursuant to Local Rule 7.1(E). Upon further consideration of the motions, the Court has determined that the initial motion to dismiss or transfer is moot. Revival of motions to dismiss under Local Rule 7.1(E) is ordinarily used in lieu of filing a second motion, such that the motion to dismiss an original complaint is treated by the Court as a motion to dismiss a subsequent amended complaint. See, e.g., Aeschliman v. Dealer Mktg. Servs., Inc., No. 14-CV-1448, 2015 WL 3463653, at 1 n.2 (C.D. Ill. May 29, 2015); Kirk v. Sprague, No. 11-CV-1397, 2012 WL 3309707, at 1 n.1 (C.D. Ill. Mar. 26, 2012). Because Lowe's has filed a motion to dismiss or transfer the Second Amended Complaint, and because the First Amended Complaint is no longer pending, no effectual relief relating to Lowe's motion to dismiss or transfer the First Amended Complaint is available. Accordingly, that motion (d/e [16]) is DENIED AS MOOT. Additionally, Lowe's Motion to Strike (d/e [26]), which requests that the Court strike an affidavit (d/e [22]) and attachments thereto filed in support of Plaintiff's Response (d/e [21]) to Lowe's motion to dismiss or transfer the First Amended Complaint, is DENIED. Rule 12(f) provides that "[t]he court may strike from a pleading an insufficient defense or any redundant, immaterial, impertinent, or scandalous matter." Fed. R. Civ. P. 12(f). Fed. R. Civ. P. 7(a)(1)(7). A response to a motion to dismiss is not a pleading and Rule 12(f) therefore cannot be used to strike any portion thereof. See E.E.O.C. v. Admiral Maint. Serv., L.P., 174 F.R.D. 643, 645 (N.D. Ill. 1997) (holding that Rule 12 cannot be used to strike any portion of a document other than a pleading); Rogers v. Cmty.
