The motion states that plaintiff made one attempt to serve the defendant and now, over a month later, has moved for this extension. The motion further states that there is a declaration of non-service attached to the motion, but there is not. There is an unexecuted summons on the docket 6 that states that the defendant is no longer employed at the location at which the process server attempted service. Based on this limited information the court cannot conclude that plaintiff has shown "good cause for the failure" to serve defendant Rami Nakhleh under Rule 4(m). The motion 7 is denied without prejudice. A renewed motion should cite the relevant rules of civil procedure and cases applying those rules to explain the basis for the motion. In addition, if plaintiff wishes to serve the defendant "by publication," as the motion requests, plaintiff should explain how that would be consistent with Rule 4(e).
