Plaintiff seeks an award of statutory damages against Defendants Tobacco & Cigars, Inc., d/b/a US Tobacco, and Mored Haleem in the amount of $30,000 for violations of the Lanham Act, 15 U.S.C. § 1114. See 15 U.S.C. § 1117 (allowing for statutory damages, in lieu of recovery of actual damages and profits, in an amount not less than $1,000 or more than $200,000 or, in the case of willful conduct, not more than $2,000,000, per counterfeit mark per type of goods or services sold, offered for sale, or distributed, as the court considers just). The Court previously entered default against both Defendants on 10/20/2020 [23]. For purpose of the default judgment motion, the Court accepts as true the allegations of the complaint as to liability. The Court has considered those allegations as well as the sworn affidavits submitted in support of Plaintiff's motion. Having considered the record in the absence of adversarial presentation, the Court finds Plaintiff's request for $30,000 in statutory damages to be reasonable and appropriate. Accordingly, Plaintiff is awarded $30,000 in damages and $400 in costs for a total award of $30,400. The Clerk is directed to enter a separate AO-450 judgment reflecting the award of $30,400 in favor of Plaintiff and against Defendants. Civil case terminated. Mailed notice (dal, ) |
