Kronstadt: A review of the parties' Joint Report (Dkt. 105 ) shows that the parties agree that this action should be stayed pending the completion of the IPR proceedings. Therefore, within ten days of this order, the parties shall file a joint stipulation and proposed order as to such a stay. Entry of that order will moot the pending motion to stay. Dkt. 70 . The proposed order shall include the requirement that the parties file a joint status report as to the IPR proceedings on the earlier of every 45 days or within ten days of any IPR decision, with the first such report due 45 days after the entry of the order on the stipulation. The joint status reports shall also include a statement of the parties' respective and/or collective positions as to whether the stay should remain in place as to all patents, or some patents, e.g., those as to which the IPR proceedings have concluded. If the parties agree that the stay should be lifted as to some or all patents, the joint report shall also include a statement of their respective and/or collective positions as to the schedule for the pretrial matters in conformance with the Standing Order as to patent cases. See Dkt. 92 , Exhibit B (Initial Patent Order) at 46-48 (Schedule of Pretrial and Trial Dates for Patent Cases). Entry of the stay is also without prejudice to the ability of any party to move to lift the stay based on changed circumstances. In addition to filing a joint stipulation to stay, within ten days of this order, the parties shall meet and confer and file a further joint report setting forth their respective and/or collective positions as to a settlement procedure and its timing, again in conformance with the Standing Order. If the parties agree to use a private neutral but cannot agree on one, each party shall propose three nominees and include their resumes and rates.
