First, plaintiff's motion to seal is denied as moot. Despite seeking to seal certain documents, plaintiff filed those documents on the public record in July 2024 (perhaps inadvertently) but, as of the date of this order, has taken no steps to have those documents stricken from the record. Thus, any protections plaintiff intended to seek with the motion to seal are now moot. Plaintiff's motion for temporary restraining order 12 is again denied without prejudice. Plaintiff has not accompanied its motion for TRO with evidence showing each of defendants' storefronts displaying the purportedly infringing product and offering to ship to this jurisdiction. Any renewed motion shall be filed by 10/25/24. The Court has reviewed the plaintiff's recent filings and orders as follows. First, the consent to proceed before a Magistrate Judge filed by plaintiff is ineffective. Pursuant to Local Rule 73.1, consent of all parties is required to consent to the jurisdiction of a Magistrate Judge. Defendants have not even appeared in this matter, let alone consented to proceed before the Magistrate Judge. Second, although the plaintiff purports to be proceeding pro se, the Clerk's Office has informed the Court that the initial filings in this case were submitted by an account registered to an attorney.
